Terms of service

These terms are the agreement between you and The Arcvex USA Inc. when you use arcvexenergy.com or buy anything from it.

By using this site or placing an order you accept these terms and our Privacy Policy. If you do not accept them, please do not use the site. We have tried to write them in plain language; where they are formal it is because the words matter.

1. Who can buy

You must be at least 18 years old to buy from us. Our products contain caffeine and other active ingredients and are not intended for children. By ordering you confirm you are 18 or over and that the payment method you use is yours to use.

We currently sell and ship to addresses in the United States only.

Everything on this site is sold for your own personal use. It is not sold for commercial resale, and not for export. If you want to stock ARCVEX, email us rather than ordering through the site.

2. Our products

ARCVEX products are dietary supplements in pouch form, intended to be placed between the upper lip and gum and then removed and discarded. They are not food, not chewing gum, and not to be swallowed.

We describe our products as accurately as we can, but photography, colour and packaging can differ from what you see on your screen, and formulations and sourcing can change over time. The label on the tin you receive is always the authoritative statement of what is in it, and it takes precedence over anything on this website. Read it before you use the product.

We may change, limit or discontinue any product at any time, and we may limit quantities available to any customer, region or order.

3. Health, safety and what these products are not

These statements have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease.

Nothing on this site is medical advice or a substitute for it. If you are pregnant or nursing, taking medication, managing a health condition, sensitive to caffeine, or unsure whether a product suits you, speak to a qualified healthcare professional before using it. Do not delay or disregard professional medical advice because of anything you read here.

Use one pouch at a time. PUSH contains 100 mg of caffeine per pouch and HOLD contains 50 mg; FLOW is caffeine-free. Count your total daily caffeine from every source, not only from pouches. FLOW contains mushroom-derived ingredients. Keep all products out of reach of children.

4. Orders and acceptance

When you place an order you are making an offer to buy. Your order is accepted when we send you a shipping confirmation, not when you check out and not when your card is authorised. Until then we may decline or cancel any order, in whole or in part, for any lawful reason — including suspected fraud, a pricing or stock error, a quantity limit, or an address we cannot ship to.

If we cancel an order you have paid for, we refund it in full. If we cannot ship within the time stated in our Shipping Policy, we will contact you and you may either agree to the delay or cancel for a full refund.

Please check your confirmation email carefully when it arrives. Once an order has been dispatched we cannot change or reroute it.

5. Prices, errors and payment

Prices are in US dollars and may change without notice. The price that applies is the one shown when you place your order and confirmed in your order confirmation.

Applicable sales tax is calculated and added at checkout. Prices shown on product pages do not include sales tax.

Despite our best efforts, a product may occasionally be listed at an incorrect price or with incorrect information. Where an error is obvious and could reasonably have been recognised as an error, we may cancel the order and refund you in full, even after it has been confirmed.

You agree that the payment details you give us are accurate and that you are authorised to use them.

6. Shipping, import duties and risk of loss

ARCVEX products are manufactured and dispatched from our facility in China and enter the United States as an import.

We act as importer and we pay the applicable customs duties. The price you pay at checkout is the total price for your order. You will not be asked for duty by the carrier and you will not receive a separate customs bill.

Delivery estimates are estimates, not guarantees. Customs clearance and carrier delays are outside our control.

Risk of loss and title pass to you when your order is delivered to the address you gave us. Until then a lost or damaged parcel is our problem, not yours, and we will replace or refund it as set out in our Shipping Policy and Refund Policy.

7. Returns and refunds

Our Refund Policy forms part of these terms. In short: unopened tins may be returned within 30 days of delivery, at your cost, once we have approved the return; opened tins cannot be returned for food safety reasons; and orders that arrive damaged, wrong, incomplete or not at all are put right without any return. Subscription cancellations are covered in section 7A below and in the Refund Policy.

7A. Subscriptions and recurring billing

Some products are offered on a subscription. If you choose one, the following applies and we will show you these terms before you enter your payment details:

What you are agreeing to. A recurring order at the frequency shown on the product page, charged automatically to your payment method until you cancel.
What you pay. The discounted subscription price shown at checkout, plus shipping and applicable tax, at each renewal. If we change the price we will tell you in advance and you may cancel before the change takes effect.
When you are charged. At checkout for your first order, and then at each renewal on the same cycle.
How to cancel. At any time, from your account or by emailing contact@arcvexenergy.com. No minimum term, no cancellation fee, no reason required. Cancelling stops all future charges; it does not retroactively refund an order already charged and dispatched.
How to skip or pause. Where your plan supports it, from the same place you cancel.

By starting a subscription you give express informed consent to these recurring charges.

8. Your account

You do not need an account to order. If you create one, keep your login details secure — you are responsible for what happens under your account. Tell us promptly if you think someone else has used it. You may not sell, transfer or share your account.

9. Reviews, feedback and anything you send us

If you send us a review, photograph, idea, suggestion or any other content, you keep ownership of it and you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, adapt and publish it in any medium, including in marketing, without payment or attribution.

You confirm that anything you send us is yours to send, is not unlawful, defamatory or infringing, and that you have disclosed any payment or free product you received in connection with it. We may edit or remove any submission, and we are not obliged to publish, keep confidential, pay for or respond to anything you send.

10. Acceptable use

Use this site lawfully. Do not use it to break any law, infringe anyone's rights, impersonate anyone, harass our staff or other customers, transmit malware, scrape or harvest data, interfere with the site's security, or circumvent any limit or restriction we apply. We may suspend or refuse service to anyone who does.

11. Intellectual property

The ARCVEX name and logo, the PUSH, FLOW and HOLD product names, and all text, photography, artwork, design and other material on this site are owned by The Arcvex USA Inc. or used under licence, and are protected by United States and international law.

You may use this site for your own personal, non-commercial purposes. You may not copy, reproduce, republish, distribute, modify or create derivative works from any of it without our written permission. Nothing in these terms grants you any licence to our trademarks.

12. Third-party links and services

Where this site links to sites or services we do not operate, we are not responsible for their content, accuracy, products or privacy practices, and we do not endorse them by linking. Read their terms before you use them, and take any complaint about them up with them.

13. Relationship with Shopify

This store is powered by Shopify, which enables us to provide the site and services to you. Any sale or purchase you make here is made directly with The Arcvex USA Inc.. Shopify is not responsible for any aspect of any sale between you and us, including any injury, damage or loss resulting from products you buy. You release Shopify and its affiliates from all claims, damages and liabilities arising from or relating to your purchases and transactions with us.

14. Disclaimer of warranties

Except where these terms or applicable law say otherwise, this site and everything on it are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, error-free or secure, or that any information on it is complete or current.

Some states do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing here limits any warranty or right that cannot be excluded under applicable law.

15. Limitation of liability

To the fullest extent permitted by law, The Arcvex USA Inc. and its officers, employees, agents and suppliers are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue or lost data, arising out of or relating to this site or any product bought through it, whether the claim is in contract, tort or otherwise, even if we have been advised of the possibility.

To the fullest extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order.

Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited. Some states do not allow certain limitations, so parts of this section may not apply to you.

16. Indemnity

You agree to indemnify and hold harmless The Arcvex USA Inc. and its officers, employees and agents from any claim, loss, liability or reasonable legal cost arising from your breach of these terms, your violation of any law or third-party right, or your misuse of any product bought from us.

17. Suspension and termination

We may suspend or end your access to this site at any time if you breach these terms or if we reasonably believe your use is unlawful or harmful. The sections that by their nature should survive — intellectual property, submissions, disclaimers, limitation of liability, indemnity, governing law and this section — survive any termination.

18. Governing law and venue

These terms and your use of this site are governed by the laws of the State of Wyoming, without regard to its conflict of law provisions. You and we agree that the state and federal courts located in Wyoming have exclusive jurisdiction over any dispute arising out of or relating to this site or anything you buy from it, and each of us consents to personal jurisdiction and venue in those courts.

Nothing in this section limits any right you have under the consumer protection laws of the state where you live, where those rights cannot be waived by agreement.

19. Changes to these terms

We may update these terms from time to time. The version published on this page is the current one, and it applies to orders placed after it is published. Where a change is material we will say so on this page. Continuing to use the site after a change means you accept it.

20. General

These terms, together with our Privacy Policy, Shipping Policy, Refund Policy and Legal Notice, are the entire agreement between you and us about this site and supersede anything said or written before. If any provision is found unenforceable, the rest continues to apply. If we do not enforce a provision, that is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours.
